ELEVENTH CIRCUIT AFFIRMS SUMMARY JUDGMENT GRANTED TO CARNIVAL

Horr, Novak & Skipp, P.A. secured summary judgment in favor of Carnival in a passenger negligence action involving a trip-and-fall on the Carnival Splendor. The Plaintiff appealed and before the appellate court were the issues of whether the district court had sufficient grounds to exclude the expert opinion of the Plaintiff’s liability expert and whether summary judgment was proper. Stephanie Wylie handled the appeal, including presentation of Carnival’s argument at oral argument. She successfully persuaded the appellate court that the expert’s testimony would be unhelpful to the jury and that summary judgment was proper.
